These Terms and Conditions govern access to CompliAccess websites, accounts, automated accessibility testing, monitoring, reports, and remediation services. By creating an account, purchasing a service, or using the platform, you agree to these terms.
1. Accounts and authority
You must provide accurate information, protect your credentials, and promptly tell us about suspected unauthorized access. If you act for an organization, you confirm that you have authority to accept these terms for it.
2. The service
CompliAccess checks web content for machine-detectable accessibility barriers, organizes findings, supports monitoring, and may provide remediation services. Automated testing detects only a subset of possible barriers. A scan, score, report, or fix is not legal advice, a legal opinion, certification, or a guarantee of compliance with AODA, WCAG, or other law.
3. Permission to scan
You may submit only websites and pages that you own, manage, or are authorized to test. You must not use the service to evade access controls, overload systems, collect private information, test non-public areas without permission, or interfere with another service. Website owners and security providers may restrict automated access.
4. Plans, billing, and renewal
Plan limits, prices, billing intervals, and included services are shown before purchase. Recurring subscriptions continue until cancelled and remain available through the paid billing period unless stated otherwise. Taxes may apply. Refunds are provided where required by law or where the applicable order terms expressly allow them. Payment processing and invoices may be provided by Stripe.
5. Remediation services
The scope, timing, access requirements, assumptions, and price for hands-on remediation are set out in the applicable order or proposal. You remain responsible for backups, approvals, third-party licences, content accuracy, and changes made after delivery. Later website changes can introduce new accessibility barriers.
6. Customer content and privacy
You retain ownership of content and data you submit. You give us the limited permission required to host, process, scan, reproduce in reports, and otherwise use that content to provide and secure the service. Our Privacy Policy explains how personal information is handled.
7. Intellectual property
CompliAccess and its licensors retain rights in the platform, software, design, methodologies, and branding. Reports and fix guidance may be used internally for the website and organization for which they were generated, subject to payment and any order-specific terms.
8. Acceptable use
You must not reverse engineer the service where prohibited by law, resell access without written permission, upload malicious code, misuse scan infrastructure, misrepresent results, infringe third-party rights, or use the service unlawfully.
9. Availability and third parties
We work to keep the service available but do not promise uninterrupted or error-free operation. Features may depend on hosting providers, email providers, payment processors, browsers, target websites, and other third parties outside our control.
10. Disclaimers and liability
To the extent permitted by law, the service is provided on an “as available” basis without implied warranties. CompliAccess is not liable for indirect, special, incidental, punitive, or consequential losses. Our aggregate liability relating to the service will not exceed the fees you paid to CompliAccess for the affected service during the twelve months before the event giving rise to the claim. Nothing here excludes liability that cannot lawfully be excluded.
11. Suspension and termination
We may suspend or end access for material breach, security risk, unlawful use, non-payment, or harm to the platform or others. You may stop using the service at any time and may cancel eligible subscriptions through the available account or billing controls.
12. Changes and governing law
We may update these terms and will post the revised effective date. Material changes may also be communicated through the service or email. These terms are governed by the laws of Ontario and the federal laws of Canada applicable there, and disputes will be brought in the courts of Ontario unless law requires otherwise.
